The FACT Act was created to require that financial institutions provide consumers with improved protection against fraud and identity theft by implementing certain safeguards to monitor suspicious activity. These FACT Act requirements will require financial institutions to re-examine their ID Theft Prevention policies and implement new procedures and business practices.

To comply with the new law, financial institutions and creditors must have in place a written program to detect, prevent and mitigate identity theft. Specifically, Section 315 and Section 114 of the FACT Act require financial institutions to:

  • Create an identity theft prevention program
  • Implement change of address safeguards when issuing credit/debit cards
  • Verify identity upon notice of address discrepancy from a consumer reporting agency
